WOMAN OF THE YEAR CAMPAIGN OFFICIAL RULES
TELL US IN 250 WORDS OR LESS ABOUT THE WOMAN OF THE YEAR, AND SHE COULD WIN A $5,000 MACY'S GIFT CARD!
1. ELIGIBILITY: Woman of the Year Campaign("Contest") is offered in ten (10) markets (each, a "Market"): Chicago (www.chicagowoy.com), Cleveland (www.clevelandwoy.com), Minneapolis (www.twincitieswoy.com), Milwaukee, (www.milwaukeewoy.com) Indianapolis (www.indianapoliswoy.com), Columbus (www.columbuswoy.com), Cincinnati (www.cincinnatiwoy.com), Grand Rapids (www.grandrapidswoy.com), Madison (www.madisonwoy.com), and Midwest (www.malibuwoy.com) (collectively, the "Markets"). Each Market is offered in the following areas (each, a "Designated Market Area" ("DMA")): DMA for Chicago: WI, IN, IL and IA; DMA for Cincinnati: OH, IN, KY; DMA for Cleveland: OH; DMA for Minneapolis: MN, WI, ND and SD; DMA for Milwaukee: IL and WI; DMA for Indianapolis: IN; DMA for Columbus: OH; DMA for Grand Rapids: MI; DMA for Madison: WI and IL; and DMA for Midwest: IL, IN, MI, OH, WI, MN, IA, ND, KY, and SD. Nominator Eligibility: Must be a legal resident of a DMA and 18 years of age or older. Nominators cannot be professional writers (e.g. persons who have been paid for their writing in the past one year). Nominee Eligibility: Must be a legal resident of a DMA and 18 years of age or older at the time of entry. Nominators and Nominees do not need to be legal residents of the same DMA. Voter Eligibility: Voters must be 18 years of age or older. Employees, officers, directors and their immediate families (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and those living in the household, whether or not related), of Chevrolet Motor Division, General Motors Corporation (the "Sponsor"), Woman Of The Year, LLC ("Promoter") and The Event Group ("Administrator"), their respective parent companies, affiliates, subsidiaries, participating dealerships and advertising and promotion agencies are not eligible to participate or win. A Nominator should have the Nominee's permission to submit her in this Contest. Void outside these DMAs and where prohibited by law. All applicable federal, state, and local laws and regulations apply.
2. TO ENTER A NOMINEE: Between 12:01 AM Central Time ("CT") on 1/17/2008 and 11:59 PM CT on 3/10/2008 (the "Contest Period") visit the designated website of your Nominee's DMA (see above) and follow the directions provided to enter your Nominee into the Contest. Nominators will be required to provide the Nominee's name, complete address, email address and a short paragraph essay of no more than 250 words explaining why the Nominee should be Woman of the Year. Entries must be received by 11:59 p.m. CT on 3/10/2008 to be eligible. A Nominator can only enter one (1) Nominee for the entire Contest Period. Subsequent entries received from any Nominator after the first entry received from that Nominator will be void. A Nominee can only be entered once in the applicable DMA for the entire Contest Period. Subsequent entries received for any Nominee after the first entry is received for that Nominee will be void. An individual may nominate herself. Incomplete or inaccurate entries and entries generated by script, macro or other automated means will be disqualified. All entries become the property of Sponsor/Promoter upon submission and will not be acknowledged or returned.
Each entry (i) must be true and verifiable, (ii) must be Nominator's own original work, (iii) may not have been previously published or submitted, (iv) must be in keeping with the Sponsor's image and (v) may not be inappropriate or offensive, as determined by the Administrator in its sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any individual's personal or property rights or any other third party rights. Administrator reserves the right to disqualify any entry it deems to be offensive, inappropriate, not in keeping with Sponsor's image or that is otherwise not in compliance with these Official Rules, in its sole discretion.
3. OWNERSHIP/USE OF ENTRY: By submitting an entry, each Nominator agrees Sponsor/Promoter shall own the entry (including the paragraph essay) submitted (including all rights embodied therein) and that it and its designees may exploit, edit, modify, and distribute the entry and all elements of such entry, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, throughout the world in perpetuity without compensation, permission or notification to Nominator, Nominee or any third party.
4. FIRST ROUND VOTING: During the Contest Period, eligible individuals will be able to vote for their favorite Nominee in each applicable DMA. To vote, visit any applicable website of DMA (see above), submit your full email address, and follow the instructions provided therein. Limit one (1) vote per person, per email address, per DMA per day. Subsequent votes received from the same email address in the same day will be void. Votes generated by script, macro or other automated means or with the intent to impair the integrity of the voting process will be void. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Administrator in its sole discretion. All votes must be received by 11:59 PM CT on 3/10/2008 to be eligible.
5. JUDGING: All eligible entries received for each applicable DMA will be judged against the eligible entries received for that DMA during the Contest Period by a panel of qualified judges selected by the Administrator. Ten (10) potential finalists will be chosen for each applicable DMA based on the following criteria: (a) the number of eligible votes Nominee received (25%) and (b) the content of the paragraph essay written as to the worthiness of the Nominee to become Woman of the Year (75%) to determine the potential finalists for each applicable DMA. Essays will be judged equally on the following criteria: grammar, originality, and persuasiveness as to Nominee's worthiness as a Woman of the Year ("Judging Criteria"). For the purpose of this Contest, the finalists will be the Nominees and not the Nominators. In the event of a tie for any DMA, such tied entries will be re-judged based on the Judging Criteria to determine the finalists. Administrator reserves the right to select fewer than ten (10) finalists and not award prizes for any DMA if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries for that DMA.
6. TO VOTE IN THE SECOND ROUND: Between 12:01 AM CT on 3/17/08 and 11:59 PM CT on 3/31/08 (the "Second Round Voting Period"), eligible individuals will be able to vote for the eligible finalists for each applicable DMA that they think should become Woman of the Year. To vote, visit any applicable website of DMA (see above), submit your full email address, and follow the instructions provided therein. Limit one (1) vote per person, per email address, per DMA per day. Subsequent votes received from the same email address or person in the same day will be void. Votes generated by script, macro or other automated means or with the intent to impair the integrity of the voting process will be void. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Administrator in its sole discretion. All votes must be received by 11:59 PM CT on 3/31/08 to be eligible.
7. DETERMINATION OF THE WINNERS: Ten (10) potential Grand Prize winners and ninety (90) potential Second Prize winners will be announced on or about 4/4/08. The finalist that receives the most eligible votes for each applicable DMA in the Second Round Voting Period will be declared the Woman of the Year and Grand Prize winner (for a total of ten (10) Grand Prize winners). The remaining nine (9) finalists in each DMA will be deemed First Prize winners. In the event of a tie, such tied entries will be judged by a panel of qualified judges based on the Judging Criteria. For the purpose of this Contest, the winners will be the Nominees and not the Nominators.
8. PRIZES: Grand Prize (10) (one (1) per DMA): Grand Prize winners will each receive a $5,000.00 Macy's Gift Card. First Prize (90) (nine (9) per DMA): First Prize winners will each receive a $100.00 Macy's Gift Card. Approximate Value of all prizes is $59,000.00. Gift card is subject to certain terms and conditions as specified by issuer. Prizes are not transferable, substitutable, or redeemable for cash. All applicable income, federal, state and local taxes and any other costs and expenses associated with receipt or acceptance of the prize are the sole responsibility of each winner. Administrator reserves the right to substitute prize with similar prize of comparable or greater value in its sole discretion.
9. WINNER NOTIFICATION: The potential winners and their Nominators, if different, will be notified by mail, email or phone and each will be required to execute and return an affidavit of eligibility and liability and, unless prohibited by law, a publicity release within ten (10) business days of date of issuance. Failure to comply within this time period or with these Official Rules, if prize or prize notification is returned as undeliverable or Administrator cannot reach a potential winner within five (5) business days of date of first attempt at contact, prize will be forfeited and, at Administrator's discretion, awarded to the applicable runner-up. If winner is at least 18 but still considered a minor in her state of residence, Administrator may, at its discretion, award prize to her parent or legal guardian, who will be responsible for fulfilling all requirements imposed on winner set forth herein. Limit one (1) prize per person.
10. GENERAL CONDITIONS: By submitting an entry, Nominator and Nominees agree (a) to be bound by these Official Rules and the decisions of Administrator, which will be binding and final; (b) to Sponsor's/Promoter's and its designees use of Nominator's and Nominee's names, cities and states of residence, likenesses and/or entry (including the paragraph essay) for advertising and promotional purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law; and (c) to indemnify, defend and hold harmless the Sponsor, Macy's Retail Holdings, Inc., Synergy Marketing Partners, The Event Group and their respective parent companies, affiliates, subsidiaries, participating dealerships and advertising and promotion agencies, and their respective officers, directors, agents and employees (collectively, the "Released Parties") from all liability, claims, law suits, costs, expenses, fees, injuries, (including death), losses, and damages resulting from participation in the Contest, acceptance or use of a prize, use of any rights granted herein and/or from a participant's fraudulent or wrongful acts or omissions. Administrator shall have the sole right to disqualify any Nominator and/or Nominee for violation of these rules or any applicable laws relating to the Contest, and to resolve all disputes in their sole discretion. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries or votes. Released Parties are not responsible for printing, typographical, technical, computer, human, network or other errors relating to or in connection with the Contest, including, without limitation, errors which may occur in any Contest related materials, the administration of the Contest, the processing or judging of entries, the tabulating of votes, or the announcement of the prizes; for stolen, lost, late, misdirected, undelivered, inaccurate, damaged, delayed, garbled or incomplete entries or votes. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, hardware. failure of any email, vote or entry to be received on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR/Promoter RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Administrator reserves the right, in its sole discretion, to suspend or cancel this Contest at any time, without notification for any reason including but not limited to computer virus, bug, worms, tampering, unauthorized intervention, fraud or other technical problem, security, or other problems or activities. In the event of cancellation, Administrator may, at its discretion, select the winners from among all eligible, non-suspect entries received for each DMA up to the time and date of such cancellation using the procedures outlined above. Any and all disputes, claims and causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Contest, and in no event shall any participant be required to receive attorney's fees or other legal costs.
11. WINNERS LIST: For a list of "Woman of the Year Campaign" winners (available after 4/4/08), send a self-addressed, stamped, business size (#10) envelope to: Woman of the Year Campaign Winners List Request, 3 S 220 Warren Avenue, Warrenville, IL 60555. Requests must be received by 4/30/08.
